To qualify for an L-1 Visa, the employee being transferred must have worked for the foreign company for at least one continuous year within the three years preceding the application.
To be eligible for the USA L-1 visa, both the employer and employee must meet certain criteria:
Employer eligibility:

- Additionally, the employer must be actively conducting business in the U.S. and at least one other country for the entire duration of the employee’s visa.
Employee Eligibilty:
- They must have worked for the foreign company for at least one continuous year within the past three years in a managerial, executive, or specialized knowledge capacity.
- They must be transferred to the U.S. to work in a managerial, executive, or specialized knowledge capacity at the U.S. branch, affiliate, parent, or subsidiary.
- They must possess the necessary qualifications and experience to perform the job duties in the U.S.
